Refund Policy

Cancellation and refund terms for paid Cosmic Stack services, including Mercury Agent cloud subscriptions. Cancel anytime; keep access through the period you've already paid for.

1. Scope

This Refund Policy explains the cancellation and refund terms for paid services offered by Cosmic Stack, with specific attention to Mercury Agent cloud subscriptions (the Standard plan at $20/month and the Advanced plan at $100/month). It is incorporated into our Terms of Service by reference.

The open-source Mercury Agent CLI is free and MIT-licensed; it is not a paid service and is not covered by this policy.

2. Mercury Agent subscriptions — cancellation

  • Cancel anytime. You may cancel your Mercury Agent cloud subscription at any time, for any reason, from your account settings or by emailing billing@cosmicstack.ai.
  • Access continues through the billing period. Cancellation stops the next billing cycle from being charged. You retain full access to the paid features until the end of the current billing period that you have already paid for. At the end of that period, your account is downgraded to the free tier and your cloud workspace is deactivated.
  • Deactivation, not immediate deletion. After cancellation, your cloud workspace is deactivated for 30 days — if you change your mind, you can reactivate it by resubscribing. After 30 days, the workspace and its collaborative knowledge are permanently deleted. Your local agent data is unaffected and remains on your machine.
  • No phone or chat required. We will never make you call a number, sit through a retention pitch, or fill out an exit survey to cancel. One click, or one email — done.

3. Mercury Agent subscriptions — refunds

  • 14-day refund window on every payment. You are entitled to a full refund of any subscription payment — including the initial payment and every renewal — if you request it within 14 days of the charge. This applies with no exceptions and no conditions. Email billing@cosmicstack.ai with your account email and we will process the refund to your original payment method within 10 business days. Your access continues through the end of the billing period you have already paid for.
  • Cancel anytime, no further charges. When you cancel, you keep access through the end of the current billing period and no further charges are made. If you cancel within the 14-day window of a payment, you may request a full refund of that payment as described above.
  • If we cancel without cause. If we cancel your subscription for reasons other than your breach of the Terms of Service, we will refund the unused, prepaid portion of your current billing period, prorated daily.
  • If we change pricing. If we increase the price of your plan and you do not wish to continue at the new price, you may cancel before the increase takes effect and no further charges will be made. Price increases do not apply mid-cycle (see Terms section 5).

4. Pay-as-you-go usage (Advanced plan)

The Advanced plan includes metered, pay-as-you-go model access billed in arrears per billing cycle. Charges for metered usage that has already been incurred are non-refundable, because they represent real per-token costs we have already paid to model providers on your behalf. You can set usage and spend caps in your account settings to control metered costs; once a cap is reached, metered calls are paused until the next cycle.

If you believe a metered charge is incorrect — for example, due to a system error that billed you for calls you did not make — email billing@cosmicstack.ai within 30 days of the invoice date and we will investigate and credit or refund verified billing errors.

5. Annual plans

If we offer annual billing in the future, annual plans will be eligible for a prorated refund of the unused full months remaining on the plan, minus the equivalent monthly rate for the months actually used, for cancellations within the first 30 days of the annual term. After the first 30 days, annual plans are non-refundable but can be canceled to prevent renewal. This section will be updated when annual plans become available.

6. Service interruptions & credits

If the Mercury Agent cloud service is unavailable for more than 1% of a billing month (roughly 7.3 hours), we will, on request, issue a service credit equal to the proportional subscription fee for the downtime, calculated against our published uptime. Credits are applied to your next invoice; they are not paid out as cash. This is a service credit, not a cash refund.

Scheduled maintenance announced at least 72 hours in advance does not count toward downtime.

7. Statutory refund rights

Nothing in this policy limits any statutory right you may have under the laws of your country of residence. In particular:

  • EU & UK consumers. You have a 14-day statutory right of withdrawal for digital services purchased online. Where you request a full or partial refund under this statutory right, we will refund you within 14 days. If you begin using the service during the withdrawal period, you may be liable for a proportional charge for the portion used, as permitted by applicable law.
  • Other jurisdictions. If the law of your country of residence provides for refunds or cooling-off periods that are more favorable than this policy, those rights apply and we will honor them.

To exercise a statutory right, email billing@cosmicstack.ai and state your country of residence.

8. How to cancel or request a refund

  • Self-serve cancellation: Sign in to your Mercury Agent cloud account, open Settings → Subscription, and click Cancel subscription. No retention flow, no questions.
  • Email: billing@cosmicstack.ai — include your account email and a one-line reason (optional). We'll process within 2 business days.
  • Refund requests: Email billing@cosmicstack.ai within the relevant window described above. Refunds are processed to your original payment method within 10 business days.

9. Changes to this policy

We may update this policy from time to time. We will note material changes here and update the "Last updated" date at the top. If a change would reduce your refund rights for a subscription you have already paid for, the change will not apply to the current billing period.
